ArtsPlay Privacy Policy

Plain-language summary (the full text below controls): We collect what we need to run ArtsPlay — your account details, your payment records (your card number goes to our payment processor, not to us), the prompts and media you submit, the media you generate, and moderation and security records. We use this information to operate the Service, process payments, keep the platform safe, and meet our legal obligations. We do not sell your personal information, we do not use your content to train AI models, and we do not run advertising trackers. Your uploads are sent to the third-party AI model providers that perform your generations — that is how the Service works. Email support@artsplay.ai to access or delete your data.

1. Who We Are and What This Covers

This Privacy Policy describes how ArtsPlay ("ArtsPlay," "we," "us"), operator of the AI creation service at https://artsplay.ai (the "Service"), collects, uses, discloses, and retains personal information. It is incorporated into the ArtsPlay Terms of Service. Capitalized terms not defined here have the meanings given in the Terms. The Service is for adults — you must be 18 or older (or the age of majority in your jurisdiction, whichever is greater).

2. Information We Collect

2.1 Account information. Email address, name (if provided), a password (stored only in cryptographically hashed form by our authentication provider), email-verification status, and account settings.

2.2 Payment information. Payments are processed by a third-party payment processor. Your full card number is collected by the processor directly and never touches ArtsPlay's servers. We receive and keep transaction records — such as the amount, date, plan purchased, transaction identifiers, card brand and last digits, and a payment-method token used for subscription renewals.

2.3 Content you submit and generate. Text prompts, uploaded reference images and videos, generation settings, and the Outputs generated for you (stored in your personal library), along with associated metadata such as the model used, credit cost, and timestamps.

2.4 Usage and device information. Log and technical data generated by using the Service — such as IP address, browser and device type, pages viewed, feature usage, generation counts, and error logs — used for security, abuse prevention, and operating the Service.

2.5 Moderation and enforcement records. Reports received, content flagged or removed, enforcement decisions, appeal outcomes, and related identifiers, as described in the Content & Moderation Policy.

2.6 Communications. Messages you send to support@artsplay.ai or dmca@artsplay.ai, and records of notices we send you.

2.7 Cookies. We use only cookies and similar technologies that are essential to the Service — primarily authentication/session cookies that keep you signed in. We do not use advertising or cross-site tracking cookies. Because we use no non-essential trackers, there is no cookie-consent toggle to manage; blocking essential cookies in your browser will prevent sign-in.

3. Biometric-Adjacent Processing

Performing a generation you request (for example, motion control or outfit/appearance swap) may involve automated processing of images and videos you upload, including detection of facial or body geometry, by the Service and by the third-party model providers fulfilling the request — solely as needed to perform that generation. ArtsPlay does not use uploaded content to identify individuals, does not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information, and does not retain biometric identifiers derived from your uploads beyond the stored Inputs and Outputs themselves. Stored Inputs and Outputs are retained as described in Section 7 and can be deleted as described in Section 8.

4. How We Use Information

We use personal information to: (a) provide, maintain, and improve the Service, including generating Outputs from your Inputs and operating your library; (b) create and secure your account and authenticate you; (c) process purchases, subscription renewals, credits, and refunds where applicable; (d) moderate content, enforce the Terms and the Content & Moderation Policy, and protect Users and third parties; (e) prevent, detect, and investigate fraud, abuse, security incidents, and ban evasion; (f) comply with legal obligations, including mandatory reporting; (g) communicate with you about the Service, including transactional emails such as verification codes, receipts, renewal reminders, and policy notices; and (h) analyze usage in aggregate to improve the Service. We do not use Your Content to train AI models, and we do not sell or share your personal information for cross-context behavioral advertising.

5. How We Disclose Information

We disclose personal information only as follows:

• Service providers. Infrastructure and database hosting, authentication, the AI model gateway and the third-party model providers that perform your generations (your Inputs are transmitted to them to fulfill your requests), our payment processor, and our transactional email provider — each to perform services for us.
• Legal and safety. To comply with law, subpoenas, court orders, and other valid legal process; to make legally required reports (including reports of apparent child sexual abuse material to the National Center for Missing & Exploited Children under 18 U.S.C. § 2258A); to enforce our Terms and policies; and to protect the rights, property, and safety of ArtsPlay, Users, and the public, including emergency disclosures where we believe in good faith there is danger of death or serious physical injury.
• Business transfers. In connection with a merger, acquisition, financing, reorganization, incorporation of the business, or sale of assets, in which case this Policy continues to apply to the transferred information.
• With your direction. When you ask us to share something (for example, an explicit opt-in to showcase your work).

We do not sell personal information and have not done so.

6. International Users

ArtsPlay operates from the United States, and your information is processed and stored in the United States, where privacy laws may differ from those of your home jurisdiction. By using the Service you understand your information is transferred to the US. Where the law of your jurisdiction grants you additional rights (for example, the EU/UK GDPR), we honor valid requests as described in Section 8 to the extent those laws apply.

7. Retention

We keep personal information only as long as reasonably necessary for the purposes above: account data for the life of your account; transaction records as required for tax, accounting, and payment-network purposes; Content until you delete it or your account is closed (subject to backup cycles); and moderation, enforcement, and security records for as long as reasonably necessary for legal compliance, fraud and abuse prevention, ban enforcement, and the establishment, exercise, or defense of legal claims — which may extend past account deletion. Content associated with zero-tolerance violations may be preserved for law enforcement as described in the Content & Moderation Policy.

8. Your Rights and Choices

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to not be discriminated against for exercising those rights. You can: (a) view and update account information in your account settings; (b) delete generations from your library; (c) close your account at any time via account settings or by emailing support@artsplay.ai; and (d) email support@artsplay.ai to exercise any access, correction, deletion, or portability right — we will verify the request via your registered email address and respond within the time required by applicable law. Deletion is subject to the retention carve-outs in Section 7. We do not respond to browser "Do Not Track" signals because we do not track Users across third-party sites; because we do not sell or share personal information for cross-context behavioral advertising, opt-out signals such as the Global Privacy Control impose no additional obligations, but we honor the underlying rights on request.

9. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the data — including encryption in transit, hashed passwords, access controls, and payment handling designed so full card data never reaches our servers. No system is perfectly secure; you use the Service at your own risk, and you are responsible for keeping your credentials confidential. If we learn of a breach affecting your personal information, we will notify you and regulators as required by applicable law.

10. Children

The Service is not directed to, and may not be used by, anyone under 18. We do not knowingly collect personal information from minors. If we learn we have collected personal information from a minor, we will delete it and terminate the associated account. Uploaded reference content may never depict a minor (see the Terms of Service, Section 7.2).

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will revise the Effective date above and, for material changes, give reasonable advance notice by email to your registered address, by notice on the Service, or both. Continued use after the effective date constitutes acceptance. The version posted at https://artsplay.ai/privacy governs.
